Wolf Greenfield Helps Inari Agriculture Win Significant Transgenic Seed Case at PTAB

Wolf Greenfield achieved a victory on behalf of Inari Agriculture, Inc., an emerging AgBio company that develops seeds and corresponding plants for a more sustainable global food system, in a post-grant review (PGR) before the Patent Trial and Appeal Board (PTAB). The Corteva patented seed was found unpatentable as lacking an enabling description under 35 U.S.C. § 112.

“This win demonstrates that 112 challenges in PGR in a post-Amgen environment can be an effective way to challenge improvidently granted patents in the unpredictable arts,” said Scott McKeown, a shareholder in Wolf Greenfield’s Post-Grant Proceedings Practice and lead counsel for Inari Agriculture.
