
George T. “Jorde” Scott
Overview
Jorde Scott focuses his practice on patent and intellectual property litigation, post-grant proceedings, and intellectual property strategy and counseling, with particular emphasis on litigation and post-grant proceedings relating to innovations in the fields of computer systems, software, and internet technology. In addition to patent litigation work, his representations have included trademark, trade dress, and trade secret infringement and misappropriation litigations.
Jorde has more than 15 years of experience that spans all phases of litigation, from pre-suit due diligence through trial and appeal. He has argued Markman hearings and dispositive motions, presented and cross-examined technical experts at trial, and presented oral argument at the Federal Circuit. Jorde has also served as lead or backup counsel in multiple inter partes reviews (IPRs) and ex parte reexaminations (EPRs) before the Patent Trial and Appeal Board (PTAB).
In addition to his litigation experience, Jorde advises clients on patent portfolio development, IP strategy, and licensing negotiations. His IP counseling includes creating portfolio management and development strategies, creating service agreements for IP-intensive business relationships, and providing solutions to IP-related employment issues.
Prior to joining Wolf Greenfield, Jorde was Counsel at a Dallas litigation boutique and the comanaging partner of a Colorado litigation boutique.
Experience
- Oxylabs v. Bright Data (E.D. Texas and PTAB): Represented Oxylabs in a series of patent litigations in the web scraping and data collection industry. Served as lead or backup counsel in IPRs and EPRs against six patents asserted by a competitor in the web scraping and data collection industry. As a result of the post-grant campaign, every single challenged claim was found unpatentable or finally rejected.
- Spoked Solutions v. Benton Energy Serv. Co. (E.D. Louisiana.): Served as lead counsel, trial second chair, and appellate counsel in a bet-the-company litigation involving patent infringement, trade secret misappropriation, and business torts on behalf of a start-up oil and gas industry research and development and manufacturing firm against a former service company customer that reverse engineered a proprietary tool to create a competing product. Obtained a stipulated preliminary injunction, critical claim construction ruling, and jury verdict of breach of contract, fraud, unfair trade practices, willful and malicious trade secret misappropriation, patent infringement and $4.5 million in damages. Secured a judgement awarding fees, a declaration that Spoked owned all of defendant’s modifications and improvements to Spoked’s tool, and enjoining defendant from using Spoked’s invention and trade secrets. Briefed and argued the appeal of the judgment, resulting in a full affirmance.
- Spoked Solutions: Served as outside general counsel for Spoked Solutions. Responsible for directing IP strategy, including the prosecution of a multi-patent portfolio covering several proprietary tools, and creating and negotiating various agreements with international industry leaders.
- Gold-Bug for Kids v. H.I.S. Juveniles (D. Colorado): Primary attorney responsible in a trademark and trade dress infringement suit by a competitor in the child safety product industry. Obtained a dismissal and release of all claims with no change to product design or packaging.
- Outdoor Edge v. EKA (D. Colorado): Represented Outdoor Edge in the successful defense of a design patent and trademark dispute between US and Swedish knife manufacturers. Secured a favorable settlement that provided the client with United States exclusivity over its design and trademark.
