Overview

John Custer focuses his practice on patent litigation and helps innovators achieve their business goals by protecting their valuable intellectual property. He has appeared numerous times before the United States Court of Appeals for the Federal Circuit as well as the First Circuit. He also has broad experience in proceedings before the International Trade Commission (ITC), various US district courts, and the United States Patent and Trademark Office (USPTO). His experience includes drafting appellate briefs as well as summary judgement and discovery motions.

John’s patent litigation experience spans diverse technologies, from fitness trackers and wearable technology to cellular communication modules and home and business security systems.

John has extensive appellate experience, including drafting briefs and arguing before the Federal Circuit. John has also assisted in multiple jury and bench trials including drafting witness outlines, prepping witnesses, and arguing jury instructions. He also has experience preparing infringement contentions and expert reports in complex SEP matters involving UMTS/LTE technology.

Prior to joining Wolf Greenfield, John worked for an Am Law 100 firm.

  • Argued before the Federal Circuit in Toyo Tire Corp. v. Atturo Tire Corp., No. 22-1817.
  • Philips v. Garmin, No. 2:19-cv-06301-AB-KS (Central District of California); 2022-2255 (Federal Circuit).
  • Briefed First Circuit appeal for pro bono client in an international child abduction case under the Hague Convention.

Interests

Enjoys playing the piano for his two daughters, giving piano lessons, and playing strategic board games.
