Wolf Greenfield Client Kantar Media Victorious Over Three TiVo Patents

On February 22nd, a federal judge in New York granted Wolf Greenfield clients Kantar Media Audiences and WPP plc summary judgment invalidating three patents belonging to TiVo Research and Analytics Inc. TiVo had described these patents as covering the “holy grail” of advertising, namely single-source matching of television viewing data with customer purchase data. TiVo sued Kantar and WPP, alleging patent infringement, and our clients moved for summary judgment. In her ruling, Judge Scheindlin agreed with Kantar and WPP and held that these three patents covered an “abstract idea” that was not eligible for patent protection under Section 101 of the Patent Act.
